Defendant General Motors, LLC's Demurrer to the Complaint is OFF CALENDAR as moot.

Defendant General Motors, LLC's Motion to Strike the Complaint is OFF CALENDAR as moot.

Defendant reserved only one motion hearing for the demurrer and did not reserve a separate motion hearing for the motion to strike. Demurrers and motions to strike require two separate motion hearings.

On December 4, 2023, Plaintiffs filed the First Amended Complaint. Thus, the demurrer and motion to strike are moot. (C.C.P., § 472(a).) Moving forward, the parties are also reminded to comply with San Diego County Local Rule 2.1.20.

If the tentative ruling is confirmed without modification, the minute order will be the Court's final ruling.
