Before the Court is Defendant City of San Diego's Demurrer to Plaintiff's First Amended Complaint.
Plaintiff filed this case on August 14, 2023. On August 31, 2023, Plaintiff filed the First Amended Complaint. (ROA 11.) In response, City filed a demurrer to the First Amended Complaint. (ROA 15-19.) On January 3, 2024, Plaintiff filed another 'First Amended Complaint' without a proof of service. (ROA 26.) Plaintiff also filed a 'First Amended Plaintiff's Response to Defendant's Demurrer to First Amended Complaint' without a proof of service. (ROA 28.) It is unclear to the Court which complaint is operative. The Court will hear from the parties.
