Defendants Jingoli Power, LLC and Karl Miller's Demurrer to Plaintiff's Complaint is OFF CALENDAR.

On April 26, 2024, Plaintiff filed the 671-page First Amended Complaint. (ROA 54.) Thus, the demurrer is moot. (C.C.P., § 472(a).) There is no proof of service of the FAC on Defendants. Plaintiff is ordered to serve the FAC on all appearing parties and file a proof of service of the FAC forthwith.

Moving forward, the parties are reminded to comply with San Diego County Local Rule 2.1.20 ['if an amended pleading is filed in accordance with the Code of Civil Procedure section 472 . . . the party filing the amended pleading must call the independent calendar clerk to notify the court that an amended pleading has been filed. Failure to call the court shall be deemed a violation of the local rules, and may give rise to an OSC re Sanctions under Code of Civil Procedure section 177.5.'].

The Case Management Conference is CONTINUED to May 17, 2024 at 10:30 a.m. in Department 70.
