Ruling on Defendants Ky Veng Chhean and Chou M. Chhean’s Unopposed Motion to Compel Responses to Form Interrogatories 

Having reviewed Defendants Ky Veng Chhean and Chou M. Chhean’s unopposed Motion to Compel Responses to Form Interrogatories, the Court rules as follows. 

On September 29, 2022, Defendants Ky Veng Chhean and Chou M. Chhean served Form Interrogatories, Set No. One, on Plaintiff Luis Fernando Martinez.   

Responses were due November 3, 2022. Plaintiff Luis Fernando Martinez has failed to provide timely responses. Defendants Ky Veng Chhean and Chou M. Chhean now move to compel responses.   

The Court grants the motion pursuant to Code of Civ. Proc. § 2030.290(b) and orders Plaintiff Luis Fernando Martinez to provide verified responses to the interrogatories compliant with Code of Civ. Proc. §§ 2030.210 (a) and 2030.220 without objections by April 30, 2023. 

 

Defendants Ky Veng Chhean and Chou M. Chhean request monetary sanctions totaling $461.65.  

The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2030.290 (c) in the amount of $461.65, calculated as follows: 

Defendants request sanctions totaling $461.65, based on 2 hours of attorney’s work at a rate of $200.00 per hour and 1 $61.65 filling fee. The Court finds this request reasonable and grants it in full. 

The sanctions total $461.65 are payable by Plaintiff Luis Fernando Martinez and his counsel by April 30, 2023.
