Ruling on Defendant RG Landscape Design, Incorporated’s Unopposed Motion to Deem Requests for Admission Admitted

            Having reviewed Defendant RG Landscape Design, Incorporated’s unopposed Motion to Deem Requests for Admission Admitted, the Court rules as follows.

            On January 25, 2023, Defendant RG Landscape Design, Incorporated served Requests for Admission, Set No. One, on Defendant Carlos Medina-Delgado.

Responses were due February 28, 2023.   Defendant Carlos Medina-Delgado has failed to provide timely responses. Defendant RG Landscape Design, Incorporated now moves the Court to deem the requests for admission admitted. 

            The Court grants the motion pursuant to Code of Civ. Proc. § 2033.280 and deems the requests to be admitted.

Defendant RG Landscape Design, Incorporated requests monetary sanctions totaling $840.00.

            The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2033.280 (c) in the amount of $420.00, calculated as follows:

RG requests sanctions totaling $840.00, based on 4 hours of attorney’s work at a rate of $210.00 per hour. 1.5 hours were spent drafting and 2.5 hours are expected in reviewing any opposition and attending the hearing. The Court notes the motion is unopposed. The Court grants $420.00 in sanctions, based on 2 hours of attorney’s work.

The sanctions total $420.00 and are payable by Defendant Carlos Medina-Delgado and his counsel by May 6, 2023.
