            Defendant Gold now moves this court for an order compelling Plaintiff to sit for his deposition.

Decision

            The motion is DENIED as MOOT.

            Subsequent to the filing of this motion, Plaintiff sat for his deposition on June 29, 2023. That deposition was terminated after 4 hours by Defendant’s counsel.

            Defendant Gold has filed a supplemental brief asking this court to order (1) Plaintiff to appear for a second session of his deposition, (2) Plaintiff not to interrupt at deposition, and (3) an award of sanctions against Plaintiff. Those requests are DENIED.

            There is currently no dispute properly before this court. Plaintiff sat for his deposition. He has not refused to continue sitting for a second session.
