Ruling on Plaintiff Farahnaz Nourmand’s Unopposed Motion to Compel Responses to Form Interrogatories
Having reviewed Plaintiff Farahnaz Nourmand’s unopposed Motion to Compel Responses to Form Interrogatories, the Court rules as follows.
On January 16, 2023, Plaintiff Farahnaz Nourmand served Form Interrogatories, Set No. Two on Defendant Gerardo Vizcaino Rojas.
Responses were due February 20, 2024. Defendant Gerardo Vizcaino Rojas has failed to provide timely responses. Plaintiff Farahnaz Nourmand now moves to compel responses.
The Court grants the motion pursuant to Code of Civ. Proc. § 2030.290(b) and orders Defendant Gerardo Vizcaino Rojas to provide verified responses to the interrogatories compliant with Code of Civ. Proc. §§ 2030.210 (a) and 2030.220 without objections by May 4, 2023.
Plaintiff Farahnaz Nourmand requests monetary sanctions totaling $410.00.
The Court awards sanctions pursuant to Code of Civ. Proc. § 2023.030 (a) and Code of Civ. Proc. § 2030.290 (c) in the amount of $410.00 calculated as follows:
Plaintiff requests sanctions totaling $410.00, based on 1 hour of attorney’s work at a rate of $350.00 per hour and 1 $60.00 filling fee. The Court finds this request reasonable and grants it in full.
The sanctions total $410.00 and are payable by Defendant Gerardo Vizcaino Rojas and his counsel by May 14, 2023.
