Judge: Cherol J. Nellon, Case: 22STCV17476, Date: 2023-08-10 Tentative Ruling
Case Number: 22STCV17476 Hearing Date: August 10, 2023 Dept: 14
Instant Motion
Plaintiff now moves this for orders
quashing 8 subpoenas served on her various subsequent employers.
Decision
The motion
is TAKEN OFF-CALENDAR. Counsel are directed to meet and confer verbally about
the dispute. If that does not resolve any given issue, counsel are directed to
schedule an Informal Discovery Conference before this court.
Discussion
This is an
improper combination motion. Plaintiff has filed a single motion attempting to
compel quash 8 separate subpoenas. There should be a separate motion (and
separate statement) for each subpoena. Additionally, filing fees must be paid for each of the motions.
There is also a practical reason
for this rule, beyond court revenue generation. Different witnesses are
situated differently, and the requests may be different as well. If parties
wrap multiple motions into a single package, the court cannot arrange its
calendar to properly distribute its workload.
Finally, the issues discussed in
the parties’ papers are not complex. Counsel should be able to work them out by
talking to one another.
