(2)   GENERAL MOTORS LLC’S MOTION TO STRIKE PUNITIVE DAMAGES FROM PLAINTIFF’S COMPLAINT is MOOT.

Background

This is a lemon law case.

On May 3, 2024, Plaintiff Donta Rhea filed suit against General Motors, LLC for SBA violations arising from his purchase of a 2018 Chevrolet Camaro.

On July 15, 2024, Defendant filed the instant demurrer and motion to strike (as to the 5^th COA for fraudulent concealment cause of action).

On September 12, 2024, Plaintiff filed its first amended complaint (FAC) (reasserting the same COAs).

Discussion

As an amended complaint has been filed, the demurrer and MTS are moot.
