Tentative Ruling
Plaintiff’s
MOTION TO BE RELIEVED AS COUNSEL is GRANTED, effective upon [see
below].
Background
This case arises from an unpaid loan of $182,774.18
(excluding interest) that was loaned from March 20, 2020 to May 31, 2022.
On July 23, 2024, Plaintiffs Osam Soliman and Shereen Latif
filed suit against Defendant Rana Soliman for:
1.
Breach of Contract
2.
Common Counts
On August 5, 2024, Defendant (in pro per) filed an answer.
On April 14, 2025, the instant motion was filed.
Discussion
Plaintiffs’ Counsel, Michael J. Hemming, seeks to be
relieved as counsel as his clients have failed to appear at three scheduled
hearings. Additionally, he has become a creditor of his clients. Despite
efforts to assist his clients and eliminate the conflict of interest, they have
failed to cooperate.
Here, the court finds good cause to grant the motion.
Generally, the court’s main concern with granting such a motion is any
prejudice to the client. There is little if any prejudice as there are no
pending motions on the calendar such that immediate representation is not of
concern. Moreover, the action is recent.
Notwithstanding, Defendant has not been served with
notice of the motion and supporting documents.
Conclusion
Based on the foregoing, Plaintiffs’ Counsel’s Motion to Be
Relieved as Counsel is GRANTED, effective upon serving the motion and documents upon Defendant and
serving the court’s order relieving Counsel sent to Plaintiffs, Defendant, and
all other parties who have appeared in the case.
