RULING RE: DEFENDANT'S EX PARTE APPLICATION TO VACATE AND CONTINUE TRIAL DATE

The Court finds this ex parte application suitable for decision in chambers without argument.

Defendant’s ex parte application to vacate and continue the trial date is DENIED.  However, the Court on its own motion advances and vacates the September 18, 2023 final status conference and October 2, 2023 trial date, and sets a trial setting conference for August 3, 2023 at 8:30 a.m.  Discovery shall remain open and the discovery and motion cutoffs will be calculated from the new trial date once it is set.
