This is an action for breach of a promissory note and guaranty thereof, including allegations of fraud in the inducement and fraudulent transfer.

            Defendants Raven Ridge Development, LLC, David Schuman and Richard Nielsen filed a Cross-Complaint alleging that Plaintiff has failed to pay Cross-Complainants their share of a Development Fee pursuant to an agreement whereby Cross-Defendants would provide funding, and Cross-Complainants would develop real properties.

             The Court entered judgment against Defendants Raven Ridge Development, LLC, Old Agoura Apartments, LLC, David Schuman, and Richard Nielsen, jointly and severally, in the amount of $1,002,293.0 in favor of Plaintiff Monrovia Villas, LLC. Plaintiff/Creditor Monrovia Villas, LLC moves for a charging order and foreclosure as to debtor David Schuman’s LLC interests.

TENTATIVE RULING

No proof of service was filed.  The hearing on Plaintiff/Creditor Monrovia Villas, LL’s motion for a charging order and foreclosure as to debtor David Schuman’s LLC interests is CONTINUED to June 23, 2023 at 8:30 a.m.  Moving party is to serve all interested parties with notice of this motion and notice of the new hearing date. Proof of service to be filed by June 1, 2023.
