TENTATIVE RULING

            On September 20, 2023, the Order granting the motion to be relieved as counsel for Defendant Edward’s Painting, Inc. was granted, which took effect on September 25, 2023, when proof of service regarding the order upon the client was filed with the Court. Defendant has not retained counsel since then. 

            “ ‘A corporation cannot represent itself in court, either in propria persona or through an officer or agent who is not an attorney.’ (Citations omitted.)”  (Merco Constr. Engineers, Inc. v. Municipal Court (1978) 21 Cal.3d 724, 729.) As such, pursuant to Civ. Proc. Code, § 436(b), Plaintiffs Cecilia Zamora Aguilar and Pedro Godoy’s motion to strike the answer of Defendant Edward’s Painting, Inc. is GRANTED and its default is hereby entered.

            Plaintiffs may submit a default judgment prove-up package.
