The following tentative ruling is issued pursuant to Rule of Court 3.1308 at 9:50 a.m. on October 22, 2024. 

Notice of intent to appear is REQUIRED pursuant to California Rule of Court 3.1308(a)(1).  The Court does not desire oral argument on the motions addressed herein. 

As required by Rule 3.1308(a)(1), any party seeking oral argument must notify ALL OTHER PARTIES and the staff of Department 76 by 4:00 p.m. on October 23, 2024.  Notice to Department 76 may be sent by email to smcdept76@lacourt.org or telephonically at 213-830-0776.

Per Rule of Court 3.1308, if notice of intention to appear is not given, oral argument will not be permitted and this tentative ruling will be adopted as the Court's final ruling.


TENTATIVE RULING ON:

(1) Motion to Compel Discovery (not "Further Discovery") of Plaintiff, Ashley Matthews, to Form Interrogatories (Set One); Request for Imposition of Monetary Sanctions Against Defendant, Lisa Cronin and her Counsel

(2)  Motion to Compel Discovery (not "Further Discovery") of Plaintiff, Ashley Mathews, to Special Interrogatories (Set One); Request for Imposition of Monetary Sanctions Against Defendant, Lisa Cronin and Her Counsel

The Court has reviewed the moving papers and the notices of nonopposition to the motions filed by Plaintiff.  The Court finds that the motions have been rendered moot by the service of responses to the disputed discovery.  At the October 22, 2024 hearing on Plaintiffs other motions to compel discovery responses by Defendant Lisa Cronin, Plaintiff's counsel notified the Court that he was reducing the sanctions requests on each of the four motions to $60 to cover the filing fees.  Accordingly, the Court will award sanctions of $60 for each of the two motions addressed here, for a total of $120 in sanctions against Defendant Lisa Cronin and her counsel of record Michael Plotkin, jointly and severally.  Sanctions are to be paid to Plaintiff's counsel within 30 days.
