Pursuant to California Rule of Court 3.1308(a)(1), the Court does not desire oral argument on the motion addressed herein.  Counsel must contact the staff in Department 76 to inform the Court whether they wish to submit on the tentative, or to argue the matter.  As required by Rule 3.1308(a), any party seeking oral argument must notify ALL OTHER PARTIES and the staff of Department 76 of their intent to appear and argue.

Plaintiffs allege that there was a known transmission defect in the 202 Ford F-150 they purchased, and that Defendant could not repair the vehicle to conform to warranties. 

Defendant moves to compel Plaintiff’s deposition.

TENTATIVE RULING

Defendant’s motion to compel Plaintiff’s deposition is GRANTED. The parties have agreed that the deposition shall occur on March 1, 2024. The Court will issue an order compelling Plaintiff’s deposition on that date to prevent Plaintiff from simply cancelling the deposition yet again, and so that Defendant may seek sanctions for disobedience to the order in the event that Plaintiff fails to appear on March 1, 2024.
