            Plaintiffs allege wage and hour violations and disability discrimination, including wrongful termination.

             Defendant Rochelle Sterling, dba Beverly Hills Plaza Hotel & Spa filed a Cross-Complaint against Contract Services Group, Inc. for indemnity in providing payroll services which violated wage and hour laws.

Defendant Rochelle Sterling, dba Beverly Hills Plaza Hotel & Spa (Doe 1) moves to compel responses to form interrogatories and requests for production of documents, and requests sanctions. 

TENTATIVE RULING 

In light of Plaintiff’s service of responses after this motion was filed, Defendant Rochelle Sterling, dba Beverly Hills Plaza Hotel & Spa (Doe 1)’s motion to compel responses to form interrogatories and requests for production of documents is MOOT. The Court notes that Defendant was required to reserve and file separate motions, but combined two motions into one,. If Defendant requires further responses, Defendant may file separate motions as appropriate. 

Defendant’s request for sanctions against Plaintiff and her counsel Lipeles Law Group APC is GRANTED[1] in the reduced amount of $690 (2 hours at $315/hour, plus a $60 filing fee). Sanctions are to be paid to Defendant’s counsel within 20 days.

The court may award sanctions under the Discovery Act in favor of a party who files a motion to compel discovery, even though no opposition to the motion was filed, or opposition to the motion was withdrawn, or the requested discovery was provided to the moving party after the motion was filed.
