            Plaintiff alleges Defendant has terminated without cause a contract whereby Plaintiff was to invest substantial capital to built production lines in two of Plaintiff’s facilities to produce Defendant’s committed production volumes of Defendant’s beverage product. Plaintiff seeks reimbursement of Plaintiff’s capital investment in equipment and certain minimum purchase payments. 

            Defendant filed a Cross-Complaint alleging that Plaintiff’s facilities resulted in tainted beverage products being distributed to customers.

Attorneys Jonathan Parente and Jamie S. George’s motion for admission pro hac vice to appear as counsel for Defendant BA Sports Nutrition, LLC are GRANTED, conditioned upon Jonathan D. Parente indicating whether his prior applications were granted or not, and whether the pro hac vice $500 filing fees per application were paid.
