            Appellant Sepehr Mikaeilian moves pursuant to Civ. Proc. Code § 995.240 for a waiver of the undertaking requirement.

TENTATIVE RULING

            The motion for waiver of the undertaking requirement is DENIED without prejudice. The proof of service only reflects service of this motion upon the Labor Commissioner, but not upon Respondent. Appellant must serve Respondent with this appeal and notice of motion for waiver of undertaking. Respondent is entitled to present evidence of potential harm if the provision for the bond is waived.
