            The hearing on Attorney Michael Ortiz moves to be relieved as counsel for Defendants Pacificland International Development, Inc. and Chun Nan Lo is CONTINUED to January 9, 2022 at 8:30 a.m.  Service of this motion was performed by mail on November 17, 2022, only 16 court days' notice taking into account the Thanksgiving holidays; however, service by mail requires 5 additional days' notice—CCP § 1005(b).

Further, moving counsel did not file and serve the proposed order on mandatory Judicial Council Form MC-053, which is required by Calif. Rules of Court, Rule 3.1362(d) & (e).) Counsel is to file and served a properly filled-out Form MC-053 pursuant to code relative to the January 9, 2022 hearing date.  

In accordance with Plaintiff’s Opposition, Defendants Pacificland International Development, Inc. and Chun Nan Lo are encouraged to locate replacement counsel before the January 9, 2022 hearing. The Court will address the issues raised in the Opposition at the January 9, 2022 hearing.

Moving attorney Michael Ortiz is to give proper notice to all parties of the continuance and of this order.
