The court denies plaintiff’s motion to compel because Plaintiff filed her motion on February 6, 2023, after the cut-off date for discovery motions to be heard for a January 30, 2023 trial date. The court has not reopened discovery. Plaintiff’s reliance on Code of Civil Procedure section 599 is unavailing because the court’s December 19, 2022, stipulated order continuing the trial to April 17, 2023, expressly did not extend non-expert discovery. (See Code Civ. Proc. 599 [continuance of trial during state of emergency extends deadlines “unless ordered otherwise by a court”].)
