Judge: Colin Leis, Case: 20STCV28247, Date: 2023-05-02 Tentative Ruling
Case Number: 20STCV28247 Hearing Date: May 2, 2023 Dept: 74
The court
grants the motion to set aside Grigoryan’s default because cross-complainant’s
reliance on Business and Professions Code section 6002.1 is misplaced. Section
6002.1, which required Grigoryan to maintain on the State Bar’s website his “[then]-current
office address . . . or, if no office is maintained, the address to be used for
State Bar purposes . . .” involves service of notice of State Bar proceedings. By
section 6002.1’s own terms, therefore, the Burbank address listed in March 2022
on the State Bar website was not necessarily Grigoryan’s “usual place of
business” (compare Code Civ. Proc. § 415.20) when, as in this case, Grigoryan
attests he did not work at the Burbank location in July 2022 when
cross-complainants attempted substitute service.
