In their wrongful death action, Plaintiffs seek recovery for personal injuries they themselves suffered from Decedent’s death; their lawsuit is not a survivor’s lawsuit seeking damages for the injuries Decedent himself suffered. Claimant paid for medical services and treatment that Decedent received before his death. (Plaintiffs paid for Decedent’s funeral and burial expenses.) Claimant cannot recoup from Plaintiffs’ recovery for their wrongful death injuries the costs of the benefits Claimant paid on Decedent’s behalf. The court grants Plaintiffs’ motion to expunge Claimants’ lien.
