Katy Silvester v. The Reserve Lounge, et al.

Motion for an Order Establishing Admissions to Plaintiff’s Requests for Admission, Set Two.

 

BACKGROUND 

 

            This action arises from a contractual dispute.

            On August 18, 2020, Plaintiff Katy Silvester (Plaintiff) filed a complaint against The Reserve Lounge (Defendant) and others. In the complaint, Plaintiff alleged breach of contract, negligent misrepresentation, account stated, and negligent interference with prospective economic advantage.

            On September 2, 2022, Plaintiff served Requests for Admission (RFAS), Set One and Form Interrogatories, Set One on Defendant Devon Spierling. On September 12, 2022, Plaintiff served RFAs, Set Two (RFAs at issue) on Defendant.

            On October 26, 2022, Plaintiff filed a motion to deem RFAs, Set One admitted.

            On October 27, 2022, Plaintiff filed a motion to deem the RFAs at issue admitted. (The hearing for this motion was set for August 15, 2023.) Plaintiff also filed a motion to compel responses to the form interrogatories.

            On February 1, 2023, the court addressed all three motions, including the motion concerning the RFAs at issue. The court found the motions moot and denied Plaintiff’s request for sanctions.

CONCLUSION

            On February 1, 2023, the court found this motion moot and denied Plaintiff’s request for sanctions.
