Motion to Shorten Time for Hearing on Motion for Leave to Amend Second Amended Complaint

The court considered the moving papers. Defendants have not opposed the motion.

BACKGROUND 

            This action arises from a dispute concerning Plaintiff’s services to Defendants in the acquisition and financing of a company engaged in aluminum production.

            On December 17, 2020, Plaintiff filed a complaint.

            Plaintiff filed a first amended complaint on February 11, 2021 and a second amended complaint on May 11, 2021.

            On March 13, 2023, the parties stipulated that Plaintiff may file a third amended complaint.

            On March 23, 2023, Plaintiff filed this motion to shorten time on the hearing for its motion for leave to amend the second amended complaint.         

DISCUSSION 

            The court finds this motion moot because Plaintiff filed the third amended complaint on March 28, 2023, pursuant to the parties’ March 16, 2023, stipulation.

CONCLUSION 

Based on the foregoing, the court finds this motion moot.

IT IS SO ORDERED.
