The court overrules the demurrer because it assumes the truth of that which must be proven, which defines begging the question: Defendant concludes Plaintiff lacks standing because, according to Defendant, Plaintiff holds no interest in the property; one purpose of the complaint, however, is to establish that Plaintiff holds an interest in the property. Defendant must file and serve her answer within 10 days of this order. Plaintiff shall give notice.
