Petition to Confirm Arbitration Award.

Petition to Confirm Arbitration

The court considered the moving papers. No response was filed.

BACKGROUND 

            This dispute arises out of work performed on a script called “Pinstripes.”

            On May 1, 2014, the contracting parties entered an arbitration agreement.

            On October 1, 2017, Petitioner Writer’s Guild of America, West, LLC (Petitioner) and Respondent E&J Films, LLC (Respondent) stipulated to entry of an arbitration award and agreed Respondent would pay the Settlement Payment of $82,206.71 plus interest.

            On January 24, 2023, Petitioner filed this petition to confirm arbitration award. Petitioner now seeks $137,745.03.

LEGAL STANDARD         

Under Code of Civil Procedure section 1285, any party to an arbitration in which an award has been made may petition the court to confirm, correct, or vacate the award. A response to this petition may request the court to dismiss the petition or confirm, correct or vacate the award. (Code Civ. Proc., § 1285.2.) A petition to confirm an arbitration award must “(a) Set forth the substance of or have attached a copy of the agreement to arbitrate unless the petitioner denies the existence of such an agreement, (b) Set forth the names of the arbitrators, (c) Set forth or have attached a copy of the award and the written opinion of the arbitrators, if any.” (Code Civ. Proc., § 1285.4.) 

DISCUSSION 

            Petitioner has complied with the Code of Civil Procedure section 1285.4. Respondent has not opposed the petition.

CONCLUSION 

Based on the foregoing, the court grants Plaintiff’s petition and confirms the arbitration award of $82,206.71 plus interest, for a total award of $137,745.03.

Plaintiff is ordered to give notice.
