Plaintiff William Aghajanian’s Motion to Deem Requests for Admissions, Set One Admitted

 

BACKGROUND 

This motion arises from an interference with prospective economic relations action.

Plaintiff William Aghajanian (Plaintiff) filed a complaint against defendant Elizabeth Johnson (Defendant). On December 23, 2024, Plaintiff propounded Requests for Admission, Set One on Defendant. Defendant failed to respond. Plaintiff moves to deem Requests for Admission, Set One admitted.

 

that is in substantial compliance with Section 2033.220.”¿¿(Id., § 2033.280, subd. (c).)¿

 

DISCUSSION

             Defendant’s responses were due on January 24, 2025, thirty-two days after service.  Defendant did not respond.  Plaintiff’s counsel made several attempts to meet and confer to no avail.  (Friedman Decl. ¶ 8-11.)  Neither party has submitted a declaration stating that Defendant has provided any responses.  (Friedman Decl. ¶ 3.) Therefore, Plaintiff is entitled to have Requests for Admission, Set One deemed admitted.

            Plaintiff requests $2,100 in sanctions, including two hours to prepare the motion and an additional hour to attend the hearing at $700 per hour.  No opposition has been filed; therefore, the Court awards $2,100 in sanctions.

 

CONCLUSION

            The Court grants Plaintiff’s Motion to Deem Admitted and awards $2,100 in attorney’s fees as discovery sanctions payable by Defendant to Plaintiff’s counsel within 30 days.
