Plaintiff Pascuala Sandoval’s Motion to Enforce Settlement

 

BACKGROUND 

This motion arises from an employment dispute.

Plaintiff Pascuala Sandoval (Plaintiff) filed a complaint against defendant Premier Property Preservation, LLC alleging multiple employment dispute causes of action.

Parties reached a settlement on September 26, 2024.

Plaintiff now moves to enforce the settlement agreement.

 

LEGAL STANDARD

Under California Code of Civil Procedure section 664.6, “the court may retain jurisdiction over the parties to enforce the settlement until performance in full of the terms of the settlement.”   If the court finds that the parties have entered into an enforceable settlement agreement, it should grant the motion and enter a formal judgment.  (Hines v. Luke (2008) 167 Cal.App.4th 1174, 1182.) 

 

DISCUSSION

             Plaintiff seeks to enforce the settlement agreement entered into by the parties on September 26, 2024.  Defendant made payments totaling $20,000.00 but owes the remaining $15,000.00.  The parties stipulated that the Court may enforce the agreement if Defendant fails to make payment.  The agreement additionally provides for attorney’s fees.  Plaintiff provides the settlement agreement and two signature pages, one for each party.  (Hoang Decl., Ex. “A.”)  Reviewing the settlement agreement and signatures, the Court finds that the settlement is enforceable.  Therefore, the Court grants Plaintiff’s motion to enforce settlement.

            Plaintiff also requests attorney’s fees under the agreement.  Plaintiff requests $2,985.00 in attorney’s fees. The Court finds this reasonable.

 

CONCLUSION

            The Court grants Plaintiff’s Motion to Enforce Settlement and grants Plaintiff $2,985.00 in attorney’s fees.
