Defendant Estrella Media, Inc.’s Demurrer

BACKGROUND 

This motion arises from a commercial unlawful detainer action. On November 11, 2024, plaintiff 2820 Hollywood Way Studios LLC (Plaintiff) filed a complaint against defendant Estrella Media, Inc. (Defendant) alleging unlawful detainer. On October 14, 2024, Plaintiff filed a related case for breach of contract.  Defendant filed a cross-complaint for Declaratory Judgment.  The Court grants the requests for Judicial Notice.

Contending there is another action pending between the parties, Defendant demurs to the complaint. The Court overrules the demurrer. A complaint for unlawful detainer is a summary proceeding limited to adjudicating possession. A complaint alleging breach of a lease involves primary rights beyond possession. The two proceedings are not the same.

Defendant shall give notice.
