Defendant General Motors LLC’s Demurrer with Motion to Strike

The court sustains defendant General Motors LLC’s unopposed demurrer to plaintiffs’ fifth cause of action alleging “Fraudulent Inducment – Concealment.” Plaintiffs’ remaining causes of action allege only Song-Beverly violations, which do not permit punitive damages when Plaintiffs also request a civil penalty as they do here. Therefore, the Court grants GM’s Motion to Strike Plaintiffs’ prayer for punitive damages.
