Defendants Oleg Reutov and Irina Reutov’s Demurrer with Motion to Strike

 

BACKGROUND 

This case arises from a breach of warranty of habitability action.

Plaintiffs Monica Young, Delvin Young, Delvin Young II, Jasza Pardue, Jaden Pardue and Messiah Pardue (Plaintiffs) filed a complaint against their landlords Oleg Reutov, individually and as trustee, and Irina Reutov, individually and as trustee (Defendants). 

On March 10, 2025, Defendants filed a demurrer with motion to strike.

On April 28, 2025, Plaintiffs filed the First Amended Complaint.

 

DISCUSSION

             On April 28, 2025, Plaintiffs filed a First Amended Complaint; therefore, the Demurrer and Motion to Strike are moot.  Defendants allege in their reply that Plaintiffs failed to file the First Amended Complaint with the Court.  The Court’s record shows that the First Amended Complaint was filed on the same day as Plaintiff’s Opposition to the demurrer and motion to strike.

 

CONCLUSION

            The Demurrer and Motion to Strike are Moot.

            Defendants to give notice.
