Plaintiff’s Motion to Amend Application for and Renewal of Judgment

BACKGROUND 

            On October 12, 2023, Plaintiff Bank of Taiwan (Plaintiff) served and filed its Application for and Renewal of Judgment.

            On October 16, 2023, the court informed Plaintiff’s counsel that the answer to question 5(g) of the application was insufficient. That is, Plaintiff’s counsel listed $30.00 as the fee for filing the application. However, the required fee is $45.00. (Gov. Code, § 70626, subd. (b).) Even so, Plaintiff’s counsel paid the $45.00 as required. (Kousherian Decl., ¶ 8; Ex. C.)

            On November 28, 2023, Plaintiff filed this motion.

LEGAL STANDARD

            “The court may, upon motion of the injured party […] correct clerical mistakes in its judgment or orders as entered, so as to conform to the judgment or order directed […].” (Code Civ. Proc., § 473, subd. (d).)

DISCUSSION 

            The court will grant Plaintiff’s motion to amend the Application for and Renewal of Judgment because Plaintiff’s counsel’s error was clerical.

CONCLUSION 

            Based on the foregoing, the court grants Plaintiff’s motion to amend its Application for and Renewal of Judgment.

Plaintiff is ordered to give notice.
