Lavender v. LA County Department of Public Health et al.

Plaintiff Keisha Lavender’s Motion to Reseal

BACKGROUND

This dispute arises from an employment dispute.

Plaintiff Keisha Lavendar (Plaintiff) filed a complaint against defendants Los Angeles Department of Public Health and San Gabriel Valley Medical Center.

The case was dismissed after settlement on June 2, 2016.

DISCUSSION

Plaintiff requests the Court “reseal” documents which Plaintiff alleges were sealed by the Court.  Documents that were sealed by the Court are kept under seal; there is no need to seek an order resealing the documents.  Sealed records are not open to inspection by the public.  (Cal. Rules of Court, rule 2.550.)  Some records are “lodged” while a motion to seal is pending, if the motion to seal is not granted, then the documents will be filed and open to the public.  If the motion to seal is granted, those documents do not become available to the public.  The Court records show that Plaintiff’s settlement with Defendants was filed under seal.  (Minute Order 10/20/15.)

The Plaintiff additionally seeks to seal documents in a case Plaintiff filed against Aaron Greenspan.  This Court does not have the authority to seal documents submitted in another action.

CONCLUSION

The Court denies Plaintiff’s Motion to Reseal.

            Plaintiff to give notice.
