Judge: Craig Griffin, Case: "AMC Investment, Inc. v. Ying", Date: 2022-08-22 Tentative Ruling

The motion of plaintiff AMC Investment, Inc., for an order summarily adjudicating four issues in its favor is continued to September 19, 2022 at 2:00 p.m., in Department N17 to permit responding defendant Roy Ying to file the declarations of Ying Fong Ong and Yanping Xie, which were referenced in the responding separate statement of material facts that he submitted but not filed with the opposition or otherwise contained in the Court’s register of actions for this file. 

The proof of service filed with the opposition (ROA 190) does not reference the declarations, and the Court cannot determine whether the defense counsel served the declarations on plaintiff’s counsel with the opposition on August 8, 2022.

When submitting the declarations to the Court, defense counsel should also serve copies of those on plaintiff’s counsel.  The declarations should be filed and served no later than August 31, 2022. 

If the declarations were not previously served on plaintiff’s counsel, plaintiff’s counsel may respond to the declarations through a supplemental reply or supplemental objections or both, to be filed and served no later than September 9, 2022.  If the declarations were previously served on plaintiff’s counsel with the opposition, no further briefing is permitted.    

Defendant to give notice of continued hearing and file proof of service thereof.
