Plaintiff Creditors Adjustment Bureau, Inc.’s unopposed Motion For Terminating Sanctions Striking Defendant’s Answer and Entering Default and Request for Monetary Sanctions is CONTINUED for 21 days.
On June 23, 2022, plaintiff filed the subject motion along with the declaration of attorney Eric Jun. Motion asserts that defendant failed to comply with the court’s order compelling it to provide answers to written discovery. The declaration establishes that there was an Order granting the subject discovery motions and that plaintiff served notice of the court’s ruling. However, the Jun declaration does not state that the defendant failed to provide discovery responses as ordered by the court.
Accordingly, the hearing on the motion is CONTINUED FOR 21 DAYS to November 7, 2022 at 2:00 p.m.
Plaintiff is directed to file and serve, not later than October 18, 2022, a supplemental declaration that establishes defendant’s non-compliance with the Court’s May 16, 2022 order. Defendant is allowed an additional 14 days from today as a final opportunity to serve by email verified code compliant answers to Form Interrogatories, Set One, and Special Interrogatories, Set Two, and to submit proof of service to the Court. If such responses are not timely provided, plaintiff is to submit a further supplemental declaration to the Court establishing same not later than November 1, 2022.
