Judge: Craig Griffin, Case: "Diaz et al vs. General Motors, LLC", Date: 2023-07-17 Tentative Ruling

The hearing on the Motion to Compel Further Responses and Documents to Plaintiff’s Request for Production of Documents, etc., as filed on 3/24/23 by Plaintiffs Alejandra Isabel Diaz and Marina Diaz Renteria (“Plaintiffs”) is CONTINUED to August 21, 2023. 

 

The Motion and Opposition papers demonstrate that both sides are willing to enter into a protective order for confidentiality in this case, and that Defendant General Motors, LLC (“GM”) is prepared to produce at least some of the documents at issue once one is entered.  However, it appears that counsel have failed to meaningfully confer to identify what aspects of the respective proposed protective orders that they have exchanged can be agreed upon, and what issues (if any) remain in dispute on that front. Counsel are thus directed to confer as to a proposed protective order for this case, and unless an agreement is reached on a stipulated proposed protective order, submit a joint statement identifying their respective proposals and the aspects of each which remain in dispute.

 

On the merits, of the six Request for Production of Documents (the “RFPs”) at issue here, it appears that upon entry of an appropriate protective order, the scope of the parties’ disagreements will at least be substantially narrowed.  Counsel are also to confer as to what specific aspects of those RFPs will remain in dispute once a protective order is entered, and then submit a joint statement identifying what remains in dispute. 

 

Counsel are to submit these joint statements at least 9 court days prior to the continued hearing date.
