Judge: Craig Griffin, Case: Duffy v. Winthrop, Date: 2022-08-08 Tentative Ruling

Before the Court is the Motion for Attorneys’ Fees filed by defendants Reid A. Winthrop and Winthrop Law Group (“Defendants”) on 5/5/22. 

On this Motion, an unauthorized sur-reply was filed by John Duffy and Laura Duffy (“Plaintiffs”) on 8/4/22, attempting to assert pages of additional arguments in opposition to the motion, in violation of C.C.P. § 1005.  Defendants have responded with a request to strike the untimely sur-reply, which effectively deprived Defendants of an opportunity to respond to the arguments presented therein.   The Court will instead CONTINUE the hearing to September 12, 2922, to provide Defendants with an opportunity to respond thereto. That response shall be filed no later than 9 court days prior to the continued hearing date. No other additional briefing, except as identified above, is permitted.

Counsel for Defendants is to give notice of this ruling.
