Defendant Samantha Velasquez’s (“Velasquez”) Motion for Leave to Amend Answer and File a Cross-Complaint is DENIED without prejudice.
There is no proof of service attached to the Motion or to any of the supporting papers. In addition, the hearing date in the original Notice of Motion was incorrect. It stated a hearing date of August 8, 2022, rather than August 15, 2022. On August 15, 2022, the Court continued the motion to ensure proper service on Plaintiff. (ROA 73.) However, Velasquez failed to file a proof of service of the motion or a notice of continuance of hearing. In addition, there is no opposition filed. Thus, the Court remains unable to determine if notice of the motion was properly given.
Accordingly, the Court DENIES the motion without prejudice to renewal.
