Judge: Craig Griffin, Case: Lewis v. County of Orange et al, Date: 2023-06-12 Tentative Ruling

Before the Court at present is the Motion for Determination of Good Faith Settlement brought under C.C.P. § 877.6, filed by Cross-Defendant Leora June Burbank (here “MP”). 

The hearing was previously continued to allow for discovery pertinent to the proposed settlement, including as to the financial condition of MP, and supplemental briefing. MP has since presented supplementation (ROA 147); no other supplementation has been submitted for this Motion. In light of the evidence now presented, as MP has now shown that she would be financially unable to satisfy any judgment in excess of the sum paid under the proposed settlement, the Motion is GRANTED.

Counsel for MP is to give notice of this ruling.
