The Special Motion to Strike filed by Defendants Jack Buffa and Cindy Buffa on 2/17/23, and joined by Defendant Karafaye Buffa on 4/24/23 is DENIED.

The motion to strike is directed at a Second Amended Complaint that is not on file with the court, as it was rejected by the clerk’s office on 2/16/23 (ROA 19) because leave of the Court was required before filing.  An unfiled Second Amended Complaint is attached to the declaration of counsel filed with the motion to strike, however as it is not the operative complaint, the motion is DENIED without prejudice.
