Judge: Craig Griffin, Case: "Nijst vs. Anaheim Global Medical Center, Inc.", Date: 2022-07-18 Tentative Ruling
The motion by defendant Anaheim Global Medical Center (“AGMC”) for a protective order limiting plaintiff Christopher Nijst’s (“plaintiff”) designation of expert witnesses and precluding plaintiff’s expert witnesses from offering cumulative testimony in their depositions and at trial is DENIED WITHOUT PREJUDICE TO REVISIT THE ISSUES RAISED BY THE MOTION VIA A MOTION IN LIMINE AT THE TIME OF TRIAL.
On 6/21/2022, AGMC filed a “Notice of Partial Resolution” of the present motion. (ROA #181). Based on that Notice, the court addresses the single remaining issue, that plaintiff designated and plans to call a nursing expert, two neurologists, and an ER physician all on the standard of care of AGMC’s nurses and hospital personnel.
At this juncture, AGMC has not demonstrated good cause for the protective order where the plaintiff’s experts are designated to render opinions on different aspects of plaintiff’s medical care in different medical specialties. (CCP §2034.250(a), (b)).
AGMC may revisit this issue at the time of trial.
