Defendant Laura Berube’s motions to compel responses from Plaintiffs Grayson Shepherd to form interrogatories (set one) and inspection demands (set one) and Kelly Shepherd to form interrogatories (set one) and inspection demands (set one) [ROAs 52-55] are MOOT. Plaintiffs state, and Defendant Laura Berube does not dispute, that, as of November 29, 2022, they have served complete and verified responses to Defendant Berube’s requests. However, because Plaintiffs’ failure to timely respond necessitated the motions, Defendant Laura Berube’s requests for monetary sanctions against Plaintiffs and their counsel is GRANTED in the amount of $2,208, payable within 30 days of notice of ruling.
Defendant City of Westminster motions to compel responses from Plaintiff Grayson Shepherd to form interrogatories (sets one and two), request for production of documents (set one), and special interrogatories (set one) and from Plaintiff Kelly Shepherd to form interrogatories (sets one and two), request for production of documents (set one), and special interrogatories (set one) are MOOT. The motions to deem requests for admissions (sets one and two) admitted against Plaintiffs Grayson Shepherd and Kelly Shepherd are also MOOT. Plaintiffs state, and Defendant City does not dispute, that, as of November 29, 2022, they have served complete and verified responses to Defendant City’s requests. However, because Plaintiffs’ failure to timely respond necessitated the motions, Defendant City’s requests for monetary sanctions against Plaintiffs is GRANTED in the amount of $2,427.80, payable within 30 days of notice of ruling.
