Judge: Craig Griffin, Case: Vo v. Hatti et al, Date: 2022-12-12 Tentative Ruling

Before the Court is the last of six Motions to Compel, which were all filed by Defendant Westminster Radiology Group, LLC (“WRG”) on 9/13/22.  The other five were heard on 12/5/22. What remains before the Court at present is WRG’s Motion to Compel Cross-Defendant Garden Grove Open MRI Center, Inc. (“GGO”) to provide further responses to WRG’s Request for Production of Documents, Set One.

On 12/8/22, counsel for GGO submitted a Supplemental Declaration of Hai H. Lai, which represents that in light of the rulings on 12/5/22, counsel agreed to provide supplemental responses for these RFPs, and has now done so. (See ROA 430, Exs. A, B.) The Motion thus appears to be MOOT, except as to the request for sanctions.

As for the sanctions request, the Supp. Decl. asserts, and the attached emails reflect, that counsel had agreed that the Motion would be taken off calendar if GGO complied with certain demands by WRG for supplementation. Mr. Lai represents that GGO has complied. Based on that representation, it appears that the Motion is being withdrawn. If that is not confirmed by WRG’s counsel by the time of the hearing, the hearing will be continued to January 9, 2023, solely to address the remaining issue of sanctions.
