Plaintiff, Fan Wang’s (“Plaintiff”) Motion to Compel Yaomin Wang’s (“Defendant Wang”) further responses to Request for Production of Documents (Set Two) and Motion to Compel Fame Luck Worldwide Co. LTD’s (“Defendant Fame Luck”) further responses to Requests for Admission (Set Two) are CONTINUED to October 24, 2022, at 2:00 p.m. in this department.
In Defendants’ oppositions, they state that they agreed to reevaluate their position on the subject discovery in light of the Court’s 8/29/22 ruling denying Defendant Wang’s motion to quash subpoenas as to his personal banking records. (See ROA 345.) Defendants’ argument that the Court’s 08/29/22 ruling “changed the proverbial landscape of the discovery disputes” has merit. The requests at issue in these motions seek financial information similar to the information that was at issue in the motion to quash subpoenas and as to which the Court ruled was relevant to Plaintiff’s claims of fraudulent misrepresentation and fraudulent transfer. (See Id.) Given that the 08/29/22 ruling thus impacts Defendants’ position as to the discovery sought and given that Defendants did attempt to meet and confer on the issues soon after the Court’s 08/29/22 ruling and appear agreeable to providing supplemental responses, the Court finds a continuance for further meet and confer is warranted in this matter.
The purpose of the meet and confer requirement is to encourage the parties to work out their differences informally to avoid the necessity for a formal order and in turn, lessen the burdens upon the court and reduce the unnecessary expenditure of resources by litigants through promotion of informal, extrajudicial resolution of discovery disputes. (Clement v. Alegre (2009) 177 Cal.App.4th 1277, 1293.)
Accordingly, the Court continues these motions to the above date and time. The parties are ordered to further meet and confer on the disputes raised by the motions and are ordered to file a joint statement listing any remaining issues 5 court days before the hearing.
The Court notes there are four other discovery motions pending in this matter. The Court urges the parties to attempt to resolve the pending motions informally.
