TENTATIVE RULING:

Plaintiff Global Financial Partners, Inc.’s UNOPPOSED Motion to Compel Responses from Defendant Brent Paysinger to Requests for Production, Set One is GRANTED.

On August 29, 2022, plaintiff Global Financial Partners, Inc. served Requests for Production, Set One on defendant Brent Paysinger by mail. (Evans Decl. ¶ 2 & Ex. A.) The deadline to serve responses to the discovery was October 3, 2022. (CCP § 2031.260(a) [responses to be served 30 days after service]; 1013(a) [five calendar days added for mail service].) Despite meeting and conferring with defendant, no responses have been served. (Evans Decl. ¶ 3 & Ex. B.) Accordingly, all objections are waived. (CCP § 2031.300(a).)

The motion is GRANTED. Within 15 days of this ruling, defendant Brent Paysinger is ordered to serve written verified responses, without objection, to Requests for Production, Set One, Nos. 1-7 propounded by plaintiff Global Financial Partners, Inc. and produce responsive documents thereto. 

For failing to comply with discovery obligations thereby forcing plaintiff to file this motion, the Court imposes a total of $322.50 in monetary sanctions on defendant Brent Paysinger. The monetary sanctions are based on 0.3 hours of work preparing the motion (instead of the 0.9 hours claimed); 0.1 hours meeting and conferring with opposing counsel to obtain responses; and 0.1 hours attending the hearing (instead of the 1 hour claimed for reviewing the opposition, preparing a reply, and attending the hearing), all at an hourly rate of $525, plus $60 in filing fees.

Monetary sanctions shall be paid to counsel for plaintiff Global Financial Partners, Inc. within 30 days hereof.
