Judge: Curtis A. Kin, Case: 21STCV39430, Date: 2022-12-06 Tentative Ruling
Case Number: 21STCV39430 Hearing Date: December 6, 2022 Dept: 72
MOTION TO BE RELIEVED AS COUNSEL
Date: 12/6/22
(8:30 AM)
Case: William Sanford et al. v.
Sheila Von Clark (21STCV39430)
TENTATIVE RULING:
Counsel MavEryck L. Stevenson’s Motion
to be Relieved as Counsel for plaintiffs William Sanford and Neenah Tran is GRANTED.
The Court signs the proposed order
with the following modifications:
·
Paragraph 5 will be revised to reflect that the
Order relieving counsel does not become effective until the filing of the proof
of service of the Order upon the client
·
Paragraph 6 will omit reference to defendant
Sheila Von Clark’s deposition, which was tentatively scheduled for a date in
the past
·
Paragraph 13 will be stricken. It is unclear to whom “the parties” in “[n]o
further contact between the parties” refers. To the extent “the parties” refers
to plaintiffs William Sanford and Neenah Tran and defendant Sheila Von Clark,
contact is necessary because the case shall proceed after moving counsel
Stevenson’s withdrawal. Insofar as “the
parties” refers to plaintiffs and Stevenson, prohibiting any future conduct
between them would seem beyond the Court’s authority.
Counsel will be relieved effective
upon the filing of the proof of service of the signed order upon the client.
