TENTATIVE RULING:

Counsel Nnana U. Awa’s Motion to be Relieved as Counsel for defendant Chong Sang Eric Tak is DENIED.

Although counsel indicates in item 3(a)(2) of the supporting declaration that the client was served with the moving papers at the last known address, counsel did not file any proof of service indicating the address at which and the date on which defendant Chong Sang Eric Tak was served, as required by CCP § 1013a.

Counsel also did not file a proof of service indicating that plaintiff 12 Albany, LLC was served. Parties that have appeared in this action must be served all motions. (CCP §§ 1005(b), 1014; Rule of Court 3.1300(a).) 

Counsel did not lodge a proposed order with the moving papers, as required by Rule of Court 3.1362(e). The proposed order must specify all hearing and trial dates, times, and places. (Rule of Court 3.1362(e); Items 7(a), 8, and 9 of Judicial Council Form MC-053.) The Court notes that the trial date of 9/14/23 indicated on item 6(b) of the supporting declaration is incorrect. Trial is currently set for 5/15/23 at 9:00 AM in Department 72 at Stanley Mosk Courthouse.
