Defendant/Cross-Complainant Sintia L. Ferrufino’s Motion for Order Deeming Admitted Truth of Facts and Genuineness of Documents is CONTINUED.

Defendant contends that she served Requests for Admission, Set One on plaintiff Steve Munoz by mail on January 18, 2023. (Miller Decl. ¶ 4 & Ex. A.) Attached as Exhibit A to defense counsel’s declaration are exhibits and a proof of service of the requests for admission. However, the written requests for admission were not included in Exhibit A. Accordingly, the matters which defendant would have the Court deem admitted were not set forth in the moving papers.

The motion is CONTINUED to _____________ at ________ in Department 72 (Stanley Mosk Courthouse). Within five (5) days hereof, defendant/cross-complainant Sintia L. Ferrufino is ordered to file and serve amended moving papers on plaintiff/cross-complainant Steve Munoz and file proof of service of the amended moving papers, as well as provide Notice of the continued hearing date.
