TENTATIVE RULING:

 

UNOPPOSED applications of plaintiff Gloria Martinez for Michael A. Josephson and Alyssa J. White to appear as counsel pro hac vice in this action on behalf of plaintiff are CONTINUED to January 18, 2023, at 9:30 a.m., in Department 72 (Stanley Mosk Courthouse).

 

On November 29, 2022, the Court continued the applications because the applications were not verified, as required by Rule of Court 9.40(c)(1). On November 30, 2022, plaintiff sufficiently addressed this defect by filing declarations from Michael A. Josephson and Alyssa J. White. The Court notes that no proofs of service were filed indicating that these declarations were served on defendants Irving Azoff and Rochelle Azoff, who filed an Answer on November 17, 2022. Parties that have appeared in this action must be served all motion papers. (CCP §§ 1005(b), 1014; Cal. Rule of Court 3.1300(a).) Failure to comply with this requirement to serve motion papers in the future may result in outright denial of the motion.

 

Plaintiff still has not submitted proof of payment of the fees required under Rule 9.40(e) to the State Bar of California. (Rule of Court 9.40(e) [“An applicant for permission to appear as counsel pro hac vice under this rule must pay a reasonable fee not exceeding $50 to the State Bar of California with the copy of the application and the notice of hearing that is served on the State Bar”].) Plaintiff includes only proof of payment of the reservation fee to the Court, which is a separate fee.

 

Plaintiff may file and serve supplemental briefing and supporting materials addressing the

defects set forth above by no later than December 30, 2022.  Any response or opposition thereto, if any, shall be filed and served by no later than January 13, 2023.
