TENTATIVE RULING:

The UNOPPOSED application of Michael P. Penza to appear as counsel pro hac vice in this action on behalf of plaintiff Cleopatra Records, Inc. is CONTINUED to March 16, 2023, at 9:30 a.m., in Department 72 (Stanley Mosk Courthouse).

Associated counsel avers that the application was served on the State Bar of California at prohac@calbar.ca.gov and james.chang@calbar.ca.gov. (Dakessian Decl. ¶ 5.) However, the State Bar website provides, “Applications for Pro Hac Vice must be submitted online through Applicant Portal and must include the above information in order for the application to be approved.” (The State Bar of California, Pro Hac Vice at https://www.calbar.ca.gov/Admissions/Special-Admissions/Pro-Hac-Vice.) The State Bar website also states, “For questions, contact the State Bar Office of Admissions at 415-538-2300 or email ProHac@calbar.ca.gov.” Based on the foregoing, it appears that the application was improperly served at ProHac@calbar.ca.gov instead of through the Applicant Portal.

Applicant is ordered to provide evidence that the application was properly served through the Applicant Portal and that the $50.00 application fee was paid.

Supplemental declarations addressing the defects set forth above shall be filed no later than March 10, 2023.

In light of the continuance of the hearing on this application, the Court, on its own motion, continues the Case Management Conference in this matter from March 15, 2023, to March 16, 2023, at 9:30 a.m.
